2. Hi-Tech Zone Talent Cards. Qualifying engineers (defined by salary band, technical qualifications, and R&D role) get a Talent Card from the Hi-Tech Zone HR bureau that confers preferential access to: – Housing rental subsidies and home-purchase priority – Child-education priority placement in Hi-Tech Zone schools – Healthcare access at preferred hospitals (Xi’an Jiaotong University Affiliated Hospitals) – Spouse work-placement assistance
Foreign WFOEs that file for Talent Cards on senior Chinese engineering hires retain talent at a measurably higher rate than those that don’t.
3. R&D bonus structures. Xi’an’s engineering-talent WFOEs commonly run hybrid cash-plus-equity bonus structures. Cash bonuses are straightforward IIT-withheld. Equity (RSUs, options, phantom equity) trigger specific Chinese tax treatments — particularly the December-2027 expiry of certain preferential equity-compensation tax treatments for foreign-invested enterprises. Plan equity grants with the December-2027 watermark in mind.
4. Dispatching (劳务派遣) and Hi-Tech Zone carve-outs. Chinese labour law caps dispatched workers (employees on a third-party dispatching agency’s payroll, seconded to the WFOE) at ≤10% of total workforce. Hi-Tech Zone offers specific carve-outs for pure R&D operations — but the documentation must be filed correctly.
5. Foreign work permit Class A/B/C. China’s foreign work-permit system runs three tiers: – Class A (senior R&D, executives, defined-shortage occupations): 5-working-day fast-track, multi-year permits, family accompaniment streamlined. The “savings” were a 2-percentage-point housing-fund line; the cost was three replacement-hiring cycles plus IP knowledge loss.
Xi’an contribution base ceiling and what gets calculated on it
The contribution base ceiling matters most for senior staff earning above it. In 2026 Xi’an, the ceiling sits at ~RMB 24,000/month (~RMB 288,000/year). 5+1 percentages cap there.
Senior engineer earning RMB 480,000/year. Effective employer cost percentage is much lower than the headline 35-38% — because 5+1 caps at RMB 288,000. The remaining RMB 192,000 attracts only IIT withholding, not employer 5+1 contributions.
This matters for compensation design: paying senior engineers above the ceiling is more cost-efficient for the employer than paying multiple junior staff at the same total.
Labour contract requirements in Xi’an
China’s Labour Contract Law applies nationally. Xi’an has minor local interpretations.

Quick example. A semiconductor packaging Tier-2 supplier in Hi-Tech Zone — “SiPack” — let go their aerospace specialist after 6 years over performance. They calculated severance correctly (6 × monthly salary). What they missed: their employment contract had specified “Hi-Tech Zone, Xi’an Hi-Tech Industries Development Zone” as the work location, and the engineer’s housing-fund obligations had been tied to the Hi-Tech Zone Talent Card programme. Termination triggered Talent Card revocation 60 days later, costing the engineer ~RMB 80,000 of housing benefits. He pursued an unfair-termination claim. SiPack settled outside court at RMB 150,000 above standard severance.
Dispatching (劳务派遣) rules
Chinese labour law restricts dispatched workers (employees of a third-party agency, seconded to the WFOE) to ≤10% of total workforce. Designed to prevent abuse of the dispatched-worker model as a labour-law workaround.
Xi’an Hi-Tech Zone carve-outs. For pure R&D operations (≥80% of workforce in R&D roles), Hi-Tech Zone allows specific exceptions to the 10% cap. Documentation must be filed at the time of dispatching agreement.
Where dispatching makes sense: short-term project specialists, prototype-stage contractors, certain expat-rotation arrangements. Not appropriate for long-term core staff.

Mistake 3: Mishandling severance for Talent-Card-holding employees
